Article 1 – Definitions

The following definitions apply to these General Terms and Conditions:

Withdrawal Period: The period during which the consumer has the right to exercise their right of withdrawal.

Consumer: A natural person who is not acting for purposes relating to their trade, business or profession and who enters into a distance contract with Bea & Jo Woodstock.

Continuous Contract: A distance agreement relating to the regular supply of products and/or services over a specified period.

Right of Withdrawal: The consumer’s legal right to withdraw from a distance contract within the applicable withdrawal period.

Business: Bea & Jo Woodstock, offering products to consumers through distance sales.

Distance Contract: An agreement concluded between the consumer and Bea & Jo Woodstock through online or other means of distance communication.

CESOP: The European Union’s Central Electronic System of Payment Information, used to monitor and report certain payment information in accordance with applicable EU legislation.

Article 3 – Scope of Application

These General Terms and Conditions apply to all offers, orders and agreements between the consumer and Bea & Jo Woodstock.

Before an agreement is concluded, these terms will be made available electronically so that the consumer has the opportunity to review them.

By placing an order through our website, the consumer acknowledges having read and accepted these terms.

Article 4 – Offers

All offers displayed on the Bea & Jo Woodstock website are subject to availability.

Bea & Jo Woodstock reserves the right to modify product prices, product descriptions and availability at any time.

Prices shown on the website include the product price and, where clearly indicated, applicable shipping charges.

Unless explicitly stated otherwise, import duties, customs charges, taxes, customs clearance fees and additional courier surcharges are the responsibility of the customer.

Article 5 – Agreement

An agreement is established once the customer has successfully placed an order and payment has been confirmed by the applicable payment provider.

After payment confirmation, the order enters the processing stage.

Customers who wish to return a product must follow the applicable return procedure described in our Return Policy.

Where applicable law provides consumers with a statutory right of withdrawal or cancellation, those rights remain unaffected by these terms.

Article 6 – Right of Withdrawal

Consumers have the right to withdraw from an eligible purchase within 14 days after receiving the product, unless an applicable legal exception applies.

The consumer does not generally need to provide a reason for exercising the right of withdrawal.

The customer is responsible for return shipping costs unless otherwise required by applicable law or explicitly stated in our Return Policy.

Products must be returned in accordance with the conditions described in our Return Policy.

Article 6a – Exclusions from the Right of Withdrawal

Products discounted by 40% or more are considered final sale and cannot be returned, refunded or exchanged, except where applicable law requires otherwise.

Sale products discounted by less than 40% may be returned in accordance with our Return Policy and applicable consumer protection laws.

Article 7 – Costs in Case of Withdrawal

For an eligible withdrawal, Bea & Jo Woodstock will process the applicable refund in accordance with the time periods required by applicable law and our Return Policy.

Returned products must be received in an appropriate condition and, where reasonably possible, in their original packaging.

A $15 restocking fee per eligible returned item may apply where permitted by applicable law and where this fee has been clearly disclosed to the customer before the purchase or return.

Article 8 – Customs and VAT

The customer is responsible for any applicable customs duties, import taxes, VAT, customs clearance charges and other costs imposed by the destination country, unless explicitly stated otherwise.

For international orders, Bea & Jo Woodstock may not act as the importer of record.

Any additional costs charged by customs authorities or courier companies during the import process are the responsibility of the customer where legally applicable.

We provide the shipping and customs documentation reasonably required for the shipment. However, we cannot guarantee customs clearance or compliance with the individual import requirements of every country.

Customers are responsible for checking the applicable import requirements before placing an international order.

Article 9 – Compliance with CESOP

Where applicable, payment service providers may be required under European Union legislation to report certain payment transaction information to the CESOP system.

Bea & Jo Woodstock cooperates with applicable legal and regulatory requirements relating to payment reporting where required.

Article 10 – Compliance and Warranty

Products sold by Bea & Jo Woodstock are intended to correspond with their descriptions and applicable product information displayed on our website.

If a customer receives a product that is defective, damaged or materially different from the product ordered, the customer should contact us in writing as soon as reasonably possible after delivery.

Customers may be asked to provide relevant information or photographs of the issue to assist with the assessment.

Where a return is required, the product should be returned in accordance with our Return Policy, subject to any rights provided by applicable consumer protection legislation.

Article 11 – Delivery

Orders are normally delivered within 30 days unless a different delivery period has been communicated to the customer.

If an unexpected delay occurs, the customer will be informed as soon as reasonably possible.

For international shipments, customs processing may affect delivery times.

Customers are responsible for complying with applicable customs and import requirements in their destination country.

Bea & Jo Woodstock is not responsible for delays caused by customs authorities, import procedures or circumstances outside our reasonable control, except where applicable law provides otherwise.

Article 12 – Complaint Resolution

Customers should submit complaints by email as soon as possible after discovering an issue.

To help us investigate and resolve a complaint efficiently, the customer should provide the order information and a clear description of the issue.

We aim to respond to complaints within 14 days of receiving them.

If a complaint requires additional investigation or more time to resolve, we will inform the customer and provide an estimated timeframe for a further response.

Article 13 – Disputes

These General Terms and Conditions are governed by the laws applicable to Bea & Jo Woodstock, subject to any mandatory consumer protection laws that apply to the customer.

Any dispute should first be addressed directly between the customer and Bea & Jo Woodstock in an effort to reach an appropriate resolution.

If the parties cannot resolve the dispute through communication, the dispute may be submitted to the competent court in accordance with applicable law and jurisdictional requirements.

Nothing in these terms limits any mandatory rights or remedies available to consumers under applicable law.
